Bhai, Gratuity ko samajhna bahut aasan hai. Maan lo tumne kisi Company mein 10 saal mehnat ki. Jab tum Resign karo ya Retire ho, toh Company tumhe ek bada Amount deti hai - isi ko Gratuity kehte hain.

Yeh koi Charity nahi hai, yeh tumhara Legal Right hai. Payment of Gratuity Act, 1972 ke tahat har Company jismein 10+ Employees hain, use Gratuity deni hoti hai. Yeh tumhari lambi seva ka Reward hai.

Kaun si Companies mein Gratuity Applicable hai?

Payment of Gratuity Act un sabhi Establishments par Apply hota hai jahan:

• 10 ya usse zyada Employees kaam karte hain
• Factories, Mines, Oilfields, Plantations, Ports, Railways
• Shops and Establishments (State Laws ke anusar)

Kuch Small Companies mein 10 se kam Employees hote hain - wahan Gratuity Act Apply nahi hota. Lekin agar kabhi 10+ Employees hue, toh Act Apply ho jata hai aur phir Employee Count kam hone par bhi Applicable rehta hai.

Gratuity Calculation Formula

Gratuity Calculate karne ka Formula bahut Simple hai:

Gratuity = (Basic Salary + DA) x 15 / 26 x Years of Service

Is Formula ko samajhte hain:

Basic Salary + DA: Last Drawn Basic aur Dearness Allowance
15: 15 din ki Salary har saal ke liye
26: Mahine mein Working Days (4 Sundays nikal diye)
Years of Service: Pure saal (6 mahine se zyada ho toh Round Up)

📈 Example 1: Rahul ki Gratuity

Basic Salary: ₹40,000
DA: ₹10,000
Total (Basic + DA): ₹50,000
Service: 8 Years 4 Months = 8 Years (4 months < 6, so no round up)

Calculation:
Gratuity = 50,000 x 15 / 26 x 8
Gratuity = 50,000 x 0.5769 x 8
Gratuity = ₹2,30,769

📈 Example 2: Priya ki Gratuity (Round Up Case)

Basic + DA: ₹60,000
Service: 12 Years 7 Months = 13 Years (7 months > 6, so round up)

Calculation:
Gratuity = 60,000 x 15 / 26 x 13
Gratuity = 60,000 x 0.5769 x 13
Gratuity = ₹4,50,000

Non-Covered Employees ka Formula:

Jo Employees Gratuity Act ke Under nahi aate (jaise Senior Management), unke liye Formula thoda Different hai:

Gratuity = (Basic + DA) x 15 / 30 x Years of Service

Dekho, yahan 26 ki jagah 30 hai. Isliye inki Gratuity thodi kam aati hai.

Payment of Gratuity Act 1972 ki Key Baatein

1. Maximum Gratuity Limit

Act ke anusar Maximum Gratuity ₹20,00,000 hai. Agar Formula se zyada aaye toh bhi ₹20 Lakh hi milega. Halaki kuch Companies apni Policy se zyada bhi deti hain.

2. Forfeiture (Kab nahi milti)

Kuch Cases mein Company Gratuity rok sakti hai:

• Moral Turpitude (Chori, Fraud) ke liye Termination
• Company ke Against koi Violent Act
• Rojgar ke dauran kisi Offense mein Conviction

3. Nomination

Har Employee ko Nominee Declare karna chahiye Form F mein. Agar Employee ki Death ho jaye toh Gratuity Nominee ko milti hai.

4. Payment Timeline

Gratuity 30 din ke andar Pay honi chahiye. Agar Delay ho toh Company ko Interest dena hota hai.

Gratuity par Tax kaise lagta hai?

Gratuity par Tax Rules samajhna jaruri hai:

Government Employees:

Puri Gratuity Tax Free hai. Central/State Government Employees ko koi Tax nahi dena.

Private Sector Employees (Covered under Act):
